California’s AB 495: Trusted Adults?

AB 495, was authored by Assembly member Celeste Rodriguez (D-San Fernando). Its primary objective was to prevent children from being involuntarily placed in foster care if their parents are detained or deported.¹

But why weren’t these children deported with their parents? Was this part of the underlying agenda? The law essentially expands the circle of “trusted adults” who can care for these children.²

AB 495: Designated Caregivers

Under the new law, parents can designate caregivers through two primary legal tools:³

• Expanded Caregiver’s Authorization Affidavits:
  
  Previously, only close relatives could sign these to enroll a child in school or authorize medical care.⁴
  
  AB 495 expands “relative” to include any adult related by blood, adoption, or affinity within the fifth degree of kinship.⁵ This includes:
  • Great-grandparents⁶
  • Cousins
  • Great-aunts and great-uncles⁷
  • Nieces and nephews
• Temporary Joint Guardianship: New probate process allows parents to nominate a “joint guardian.”
  
  A person is empowered to act only after an “activating event,” (i.e., parental detention or deportation). This ensures the child’s stability while preserving parental rights.⁸

California’s AB 495: “Sex Trafficker’s Dream”?

Proponents claim the bill is an act of “chesed” for the vulnerable, but conservative and religious leaders strongly opposed it.¹⁰

Critics, including Pastor Jack Hibbs and various parental rights organizations, argued that the bill’s language was dangerously broad.¹¹

“This is actually a dream come true for kidnappers, traffickers, and pedophiles,” Pastor Jack told FOX News. “It is so bad, so dangerous.”

The controversy largely centered on:

• The “Unreachable” Clause: Opponents fear the law’s caregiver affidavit provision could be exploited for child claims without oversight.¹²
• Parental Erasure: Activists argued that the bill undermined the biblical and constitutional authority given to parents by God. In other words, “the state” will decide kinship ties over the immediate nuclear family.¹³

So What Happened As a Result of The Opposition?

In response to the outcry, AB 495 was amended before final passage. It removed “nonrelative extended family members” (like neighbors or mentors) and limit the expanded affidavit to blood and kinship relatives.¹⁴
